Professional violinist Brian King Joseph has filed a lawsuit in Los Angeles over allegations Will Smith and its management company from sexual harassment, retaliation and wrongful termination. The legal filings focus on alleged incidents that Joseph says occurred during Smith’s Based on a true story: 2025 worldwide tour, in which he describes experiences that he believes were deeply distressing and professionally damaging.
The lawsuit, filed on December 30, 2025 in the Superior Court of California, names Smith and his company, Treyball Studios Management, Inc., as defendants. According to the complaint, Joseph’s professional relationship with Smith began in late 2024 after performing at a show in San Diego, where he was subsequently invited to join the world tour and contribute to the recording of new music.
The lawsuit and the accusations
At the center of the lawsuit is an incident that Joseph alleges occurred during the tour’s stop in Las Vegas in March 2025. According to the complaint, Joseph returned to his hotel room — booked by Smith’s team — after rehearsals and a long day of travel and discovered signs that someone had entered without his permission. He claims there was no evidence of forced entry and that only hotel staff and tour management had access to the room.
Joseph claims he was in the room a handwritten note addressed to him reading: “Brian, I’ll be back later at the latest [sic] 5:30, just us,” accompanied by a heart and signed “Stone F.” The complaint further states that the room contained several items that did not belong to him, including wipes, a beer bottle, a red backpack, hospital discharge papers and a bottle of HIV medication with someone else’s name on it.
Joseph says he interpreted the note and the presence of these items as a threat of sexual violence or unwanted sexual contact. In response, he reported the incident to hotel security, contacted local law enforcement on a non-emergency line and notified members of Smith’s tour management.
What followed, Joseph claims, is central to his claims. Instead of launching an investigation, a tour representative reportedly suggested he had made up the incident and accused him of lying. Within days, he said he was removed from the tour and replaced by another violinist. The lawsuit characterizes this termination as retaliation directly related to his reporting of a safety concern.
Grooming, Predatory Behavior, and Termination Claims

In addition to the hotel incident, the complaint alleges a broader pattern of inappropriate behavior. Joseph claims that Smith engaged in behavior that he considered grooming, and claimed that Smith was “intentionally preparing Mr Joseph for further sexual exploitation” as their professional relationship developed.
According to the lawsuit, Smith made comments about a “special connection” between them, which Joseph describes as part of a pattern that preceded the alleged harassment. These interactions, the complaint alleges, have contributed to an environment in which boundaries are blurred and power dynamics are exploited.
Joseph is seeking damages for emotional distress, damage to reputation, loss of income and ongoing psychological effects, including post-traumatic stress disorder. He further claims that his termination violated California labor protections, whistleblower laws and anti-harassment statutes.
Immediate aftermath and public reaction

At the time of publication, neither Will Smith nor representatives of Treyball Studios Management have issued a public statement in response to the lawsuit. In cases of this magnitude, silence or limited comment is not uncommon, especially in the early stages of a lawsuit, when public statements can have legal ramifications.
These allegations mainly stem from the increased legal scrutiny surrounding the Smith family. A separate lawsuit was filed against it earlier in December Jada Pinkett Smith by a former employee, marking a particularly controversial legal period.
